DIGITAL REALTY LOSES KEY DATA? INCIDENT GOES TO JUDGE FOR REVIEW

The IT department at Digital used to be second to none so why are they now unable to preserve data required by their document retention policy.  Is it really gone or jsut in hiding?

In an email between two employees at Digital Realty in March, 2014, there is a reference to voicemail left by one of the employees.

Plaintiff Somers requested the voicemail file which he has a right to. Under its document retention policy, overseen by Josh Mills and Michael Henry, the voicemail should have been preserved.  In additon, Somers’s attorney issued a litigation hold to Digital on or about May 1, 2014.

After months of letters and emails, Chubb’s lawyers, Seyfarth Shaw, decided to say that they cannot find it. They will not say who at Digital looked for it or why it is missing.
